INTRODUCTION

Move On, Inc. (“Move On,” “us,” “our,” or “we”) values its relationship with you and takes your privacy seriously. This Privacy Policy (this “Policy”) describes the types of information we may collect from you or that you may provide when you visit any of our websites, including without limitation https://choosemoveon.com (our “Website”), or access and use our mobile application (“App,” and together with the Website, the “Move On Platforms”) in order to purchase moving or delivery services provided by third party providers, receive an estimate or information about such services, view our blog, or otherwise use our services (collectively, the “Services”), and our practices for collecting, using, maintaining, protecting and disclosing such information.

PLEASE READ THIS POLICY CAREFULLY TO UNDERSTAND OUR POLICIES AND PRACTICES REGARDING YOUR INFORMATION AND HOW WE WILL TREAT IT. BY ACCESSING OR USING THE MOVE ON PLATFORMS, YOU AGREE TO THIS POLICY, INCLUDING CONDUCTING THIS TRANSACTION ELECTRONICALLY AND A CHOICE OF TENNESSEE LAW. IF YOU DO NOT AGREE WITH THESE POLICIES AND PRACTICES, YOU MAY NOT USE THE MOVE ON PLATFORMS. WE MAY UPDATE THIS POLICY AT ANY TIME, AND MODIFICATIONS ARE EFFECTIVE UPON BEING POSTED THROUGH THE MOVE ON PLATFORMS. YOUR CONTINUED USE OF THE MOVE ON PLATFORMS AFTER WE MAKE CHANGES IS DEEMED TO BE ACCEPTANCE OF THOSE CHANGES.

This Policy applies to information we collect through the Move On Platforms. It does not apply to information collected by us offline or through any other means, including on any other website operated by any third party, including through any application or content (including advertising) that may link to or be accessible through the Move On Platforms.

INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We collect several types of information from and about users of the Move On Platforms, including:

Personally Identifiable Information: Information by which you may be personally identified or contacted, whether directly or indirectly, such as name, postal address, e-mail address, telephone number, credit card information, and biographical information (“Personal Information”).

Anonymous Information: Information that is in a form that does not permit direct association with a specific individual and is aggregate data that website and applications use to administer their sites, services, and content. Anonymous information may include such information as your browser or device type, your IP address, log file information, cookie and web beacon information, and information from similar tracking technologies.

We collect this information in a range of ways, as further described below:

Directly from you when you provide it to us through the Move On Platforms.

Automatically as you navigate through the Move On Platforms. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons, and other tracking technologies.

From third parties, for example, our business partners or third party providers.

The information we collect on or through the Move On Platforms may include:

Information that you provide by filling in forms through the Move On Platforms. This includes information provided at the time of purchasing Services, subscribing to our blog, posting material, submitting feedback or a review, or requesting further Services or an estimate for Services.

When you report a problem with the Move On Platform or report an issue with our claim center. This information includes your email address and any other information you choose to provide Move On.

We also may ask you for information when you elect to participate in an educational scholarship application process, contest, or promotion sponsored by us. This information includes name, address, phone number, email address, and may, in some instances, include educational and biographical information.

Records and copies of your correspondence (including e-mail addresses), if you contact us.

Details of transactions you carry out through the Move On Platforms and of the fulfillment of your Service orders. You may be required to provide financial information before placing an order through the Move On Platforms.

Your search queries through the Move On Platforms.

You also may provide information to be published or displayed (hereinafter, posted) on public areas of the Move On Platform, or transmitted to other users of the Move On Platforms or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Move On Platforms with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

(2) Information We Collect Through Automatic Data Collection Technologies.

As you navigate through and interact with the Move On Platforms, we may use automatic data collection technologies to collect certain information about your browsing actions and patterns, including:

Details of your visits to the Move On Platforms, including traffic data, location data, logs and other communication data and the resources that you access and use through the Move On Platforms.

Information about your computer and internet connection, including your IP address, operating system and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).

The technologies we use for this automatic data collection may include:

Cookies (or browser cookies). A “cookie” is a small file placed on the hard drive of your computer by a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Move On Platforms. These features are not yet uniform, so we may not respond to such features or signals. At times, if you remove or reject cookies, it could affect how the Move On Platforms work for you. However, if you select this setting you may be unable to access certain parts of the Move On Platforms. Certain features of the Move On Platforms may use local stored objects (or flash cookies) to collect and store information about your preferences and navigation to, from and on the Move On Platforms. Flash cookies are not managed by the same browser settings as are used for browser cookies. Web Beacons. Pages of the Move On Platforms and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Move On to, for example, count users who have visited those pages or opened an e-mail and for other related Service statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

(3) Third-party Use of Cookies and Other Tracking Technologies.

Move On may from time to time contract with third parties to assist us in collecting, maintaining, and managing user information, processing credit card and payment information, and providing analytics regarding your interactions with the Move On Platforms and other third-party websites so that we may improve the Move On Platforms. Some content or applications, including advertisements, through the Move On Platforms are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Move On Platforms. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties tracking technologies or how they may be used. HOW WE USE YOUR INFORMATION

For our other legitimate interests to make available and highlight content and opportunities that are relevant to you, improve the Move On Platforms, maintain our relationship with you, and protect users of the Move On Platforms and customers, where your rights and freedoms do not outweigh these interests. We use information that we collect about you or that you provide to us to:

Present the Move On Platforms and its contents to you;

Operate, maintain, and improve the Move On Platforms and products, including to develop new products and services;

Use your geolocation to provide location-based services, including locating third-party providers of moving and delivery services near you;

Provide you with information, estimates, products, or services that you request from Move On;

Send information including notices about your service requests, confirmations, schedules, invoices, reservation dates, information about our employees or contractors, and support and administrative messages;

Notify you about changes to the Move On Platforms or any products or services we offer or provide though it;

Respond to comments and questions and provide customer service support;

Communicate with you about promotions, educational scholarships, our blog, and other news about products or services offered by us;

Deliver targeted marketing, service updates, and promotional offers based on your communication preferences, and to measure the performance of our email marketing campaigns;

Decide which ads to show you by only showing you those that “match” your past viewing, browsing and shopping activity. Many advertising services collect and use data from your web and mobile app activity both on and off the Move On Platforms to help show you ads that are more targeted to your interests;

Analyze your use of the Move On Platforms, including interactions with applications or services made available, linked to, or offered through the Move On Platforms;

Carry out our obligations and enforce rights arising from any contracts entered into between you and us, including for billing and collection;

Protect, investigate, and deter against fraudulent, unauthorized, or illegal activity; or

With your consent, we may use your Personal Information to provide you with marketing via telephone calls, emails, SMS or text, or provide you with marketing from third parties.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Additionally, we may contract with service providers to serve ads on our behalf across the Internet. They collect information about your use of the Move On Platforms. They also may use information about your visits to the Move On Platforms and other websites to improve the features and functionality we make available through the Move On Platforms. In all cases, however, we will only use your information as permitted by applicable law.

The information we collect automatically is statistical data and may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve the Move On Platforms and to deliver a better and more personalized service, including by enabling us to:

To third parties to market their products or services to you if you have not opted out of these disclosures. We will contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them;

To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use the e-mail a friend feature of the Move On Platforms, we may transmit the contents of that e-mail and your e-mail address to the recipients;

To comply with any court order, law or legal process, including to respond to any government or regulatory request;

If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our business, customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction, in the event of an emergency, and in order to enforce our agreements, policies, and Terms of Use; or

With your consent.

We may also share aggregated non-personal information about our users with others without restriction.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the Personal Information you provide to Move On. We have created mechanisms to provide you with the following control over your information:

Promotional Offers/Marketing from Move On. If you do not wish to have your e-mail address/contact information used by Move On to promote our own or third-party products or services, you can opt-out by contacting us by e-mail at [email protected] or by telephone at 1 (888) 836-3939. Additionally, our marketing emails tell you how to opt-out of receiving further marketing correspondence. If you opt out, we may still send you non-marketing emails, including emails concerning service purchases and our other business dealings with you. Your opt-out request may take up to ten (10) business days to process, and you may receive communications from Move On or its third-party providers in the meantime.

Personalized Advertising. If you do not wish to participate in our advertising personalization programs, you can opt-out by following the directions provided within the applicable advertisement, or through the methods included above for Information We Collect Through Automatic Data Collection Technologies in the section above. You may also opt out of receiving interest-based ads from Amazon, Facebook and Google. You will continue to see ads on each platform, but they will not be personalized as a result of your actions on our website. The effect of an opt-out will be to stop personalized advertising, but it will still allow the collection of personal information as otherwise described in this Policy.

We do not control third parties collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (NAI) on the NAIs website.

ACCESSING AND CORRECTING YOUR INFORMATION

You may send us an e-mail at [email protected] to request access to, correct or delete any Personal Information that you have provided to Move On. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your Personal Information from the Move On Platforms, copies of your Personal Information may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Move On Platforms. Proper access and use of information provided on the Move On Platforms, including Personal Information, is governed by our Terms of Service.

LINKS TO THIRD PARTY WEBSITES AND SERVICES

The Move On Platforms may have links to other websites that are not operated by Move On. Inclusion of any linked website on the Move On Platforms does not imply or express an approval or endorsement of the linked website by Move On, or of any of the content, opinions, products, or services provided on these websites. Even if an affiliation exists between the Move On Platforms and a third-party web site, we exercise no control over linked site. We have no control over how these websites may collect your information and no liability for the practices, policies and security measures implemented on these websites. You should read the privacy policies on those other websites before you submit your information through them.

OUR COMMITMENT TO CHILDREN’S PRIVACY

Protecting the privacy of children is important to Move On, and the Move On Platforms are not intended for children under 13 years of age. The Children’s Online Privacy and Protection Act of 1998 (“COPPA”) defines a “Child” as anyone under the age of thirteen (13) years old. We strictly adhere to COPPA, and we do not collect Personal Information from those we actually know are under 13. If you are under 13, do not use or provide any information through the Move On Platforms or on or through any of its features, register through the Move On Platforms, make any purchases through the Move On Platforms, use any of the interactive or public comment features of the Move On Platforms, or provide any information about yourself to Move On. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. YOUR CALIFORNIA PRIVACY RIGHTS

The California Civil Code permits users of the Move On Platforms that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Your request must include your postal address so that we may provide you with notice and third party direct marketing opt out form.

DATA SECURITY

Security of information communicated by or to us over the Internet is of utmost concern to us; unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through the Move On Platforms. Please note that email, like most non-encrypted Internet communications, may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use email or submit through the Move On Platforms any information that you consider confidential. While we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or through the Move On Platforms, and you do so at your own risk.

We urge you to be careful about giving out information in public areas of the Move On Platforms like message boards. The information you share in public areas may be viewed by any user of the Move On Platforms.

SPECIAL NOTICE TO NON-UNITED STATES USERS

If you are located outside the United States of America and are using the Move On Platforms, you should be aware that your Personal Information will be transferred to the United States of America, the laws of which may be deemed by your country to have inadequate data protection. If you are located in a country outside the United States of America and voluntarily submit personal information to Move On, you thereby consent to the general use and onward disclosure of such information as provided in this Policy and to the transfer of that information to and storage of that information in the United States of America.

CONSENT AND JURISDICTION

This Policy and the use of the Move On Platforms are governed by the laws of the State of Tennessee, without giving effect to its conflicts of law provisions. Any claim related to the Move On Platforms or this Policy shall be brought in a federal or state court having jurisdiction over Chattanooga, Tennessee, within one year after the claim arises. Users of the Move On Platforms consent to the jurisdiction and venue of such courts as the most convenient and appropriate for the resolution of disputes concerning this Policy. This Policy and the notices outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any third party.
